On May 30, the Supreme People's Court (SPC) held the fourth lecture of its judge forum themed "Exploration and Practice of a Modern Corporate Compliance Judicial System with Chinese Characteristics".
Zhang Jun, president of the SPC, and Fang Guanghua, vice-chairman of the All-China Federation of Industry and Commerce (ACFIC), attended and addressed the lecture.
During the lecture, judges from the SPC, intermediate people's courts and courts at the grassroots level presented specific cases related to corporate compliance reforms in criminal, civil, administrative and law enforcement domains.
Vice-Chairman of the ACFIC Huang Daifang, who is also a deputy to the National People's Congress, along with representatives from the Supreme People's Procuratorate, ACFIC and universities, spoke at the lecture.

In his speech, Zhang said that the corporate compliance reform is rooted in the reality of the nation’s economic and social development, combining the important institutional aspects of "rigorous governance" and "comprehensive support."
He highlighted the organic integration of political and legal perspectives in the reform, and the implementation of policies that are more conducive to the sustainable development of private enterprises.

Zhang underlined the need to be fully aware of the fact that China's private enterprises are still growing, relevant systems still require improvement and the modern corporate system has yet to take shape. Therefore, efforts are needed to assist the involved enterprises in corporate appliance reform to ensure their sustained development, he added.
Private enterprises need to operate in compliance with laws and regulations and resolutely say no to illegal practices such as bribery, tax evasion, smuggling and intellectual property infringement, he stressed.

He also called for collaborative efforts from related departments in advancing the corporate compliance reform and translating reform practices into legal provisions to ensure law-based implementation. A joint oversight system should be established for the improvement of the legal system, striving for a continuously improved law-based business environment by removing institutional barriers hindering Chinese modernization, he noted.

In his address, Fang urged private entrepreneurs to deeply understand the determination of the central government to further develop and strengthen the private economy, recognize the relentless efforts of judiciary authorities in creating a better law-based business environment for the private economy, and actively contribute to advancing Chinese modernization through high-quality development.
