The Supreme People’s Court of the People’s Republic of China recently released the statistics of judicial work in the first half of 2023.
In the first half of 2023, the courts nationwide received 16.96 million new cases of various types, a growth of 11.01% over the previous year. 15.26 million were concluded, an increase of 9.65%, and 4.54 million remained unconcluded, a decrease of 4.45%. The backlog of cases has been cleared with 7.36% increase of concluded criminal cases and 8.64% decrease of the unconcluded cases, 7.76% increase of the concluded civil cases and 4.34% decrease of the unconcluded cases, 2.53% and 2.06% decrease of the concluded and unconcluded administrative
The efficiency and quality of handling the pre-litigation mediation have been improved. A total of 7.71 (up 41.5%) million disputes were mediated through pre-litigation, accounting for 36% of disputes filed before the court. The average period for each pre-litigation was 13.9 days. Roughly 5 million disputes were successfully resolved through mediation, an increase of 51.2% over the previous year, and the rate of voluntary execution by the concerned parties reached 94.6%. The courts’ mediation platforms were further arranged in the rural areas, communities, etc. 101,000 community-level administrations cooperated online with the local people’s courts and handled a total of 910,000 disputes, nearly three times the number of last year. Over 1,000,000 disputes were resolved in villages, communities and neighborhoods. Over 7, 000, 000 cases were filed online, an increase of 18.95%, and an average of 119.5 cases per minute were filed online. A total of 98,000 online applications for second-instance filings were received in 16 pilot areas, with an average filing period of 21.6 days.
The courts nationwide did their best to protect the technology innovations and safeguard the fair competition in the market. The high-quality judicial service has been playing a constructive role in promoting IP work. 12,000 new technology-related IP cases of first instance were received, 9,916 of which were concluded, up 18.4%. Due to the diversified and improved dispute resolution mechanism, a large number of IP disputes have been resolved through mediation. The punitive compensation system was applied in 139 cases in accordance with the law, with a maximum compensation of 20 million yuan imposed, significantly increasing the cost of right infringement and violation of the law.
