    NTD Delivered Speech on the Seminar of Trademark Practice in Internet Economy by AIPPI

    On May 14, 2021, AIPPI China with Zhejiang Intellectual Property Research and Service Center jointly held the Seminar on Trademark Practice in Internet Economy at Hangzhou city, Zhejiang province, known as the “City of Internet”.  Over 100 practitioners in the trademark sector from the judicial offices, the administrative organs, the academic circles, the enterprises, the law offices and the IP agencies attended.

    Ms. Wei Zhou, Partner of NTD and Member of Trademark Committee of AIPPI China, delivered a speech on “Cancellation of the Registered Trademark not Used for Three Consecutive Years without Good Reasons in the New Business Form of Internet” at the opening. She analyzed the typical cases concerning the trademark cancellations, and shared her comments on the different criterions for hearing the cancellations, the reviews of adjudication on opposition, as well as the problems caused thereby. Moreover, Ms. Zhou also introduced the laws and regulations for protecting the defensive trademarks. The speech was highly appraised by the attendees.

    The guests from the Supreme People’s Court (SPC), the China Intellectual Property Administration (CNIPA), the Hangzhou Yuhang District People’s Court, the Institute of Law of China Academy of Social Sciences, Alibaba Group, COFCO Corporation, Baidu, the law firms and agencies were invited to the seminar. With two topics of “Cancellation of the Registered Trademark not Used for Three Consecutive Years without Good Reasons in the New Business Form of Internet” and “Studies on Protecting Trademarks of Goods and Services in the New Business Form of Internet”, the participants discussed the related laws and the practices based on the characteristics of internet economy, and the necessity of registering trademarks of the internet goods/services for their “cross-boundary” feature, the difficulties for providing evidences of trademark use, and the opinions for determination of trademark infringements.

    The seminar highlighted the collisions sparked by the different views for a common legal practice, and won a complete success for its warm echo.
