    CNIPA Released First Half of 2019 Statistical Data on Intellectual Property

    On July 9, 2019, the National Intellectual Property Administration (CNIPA) held the Regular News Briefing of Third Quarter of 2019 at Beijing, on which the statistical data on patents, trademarks, geographical indications and layout designs of integrated circuits of the first half of this year was released centrally. The conference also published the development trends of China’s intellectual property (IP) work. 

    As shown in the data, in the first half of 2019, China’s major IP indicators are kept in line with the forecast, that is, our comprehensive strength of intellectual property is steadily improved.

    Major Statistical Data

    Patent:

    In the first half of 2019, 649,000 invention patent applications were received by CNIPA, down 9.4% year-on-year and 38,000 invention patents were granted, up 9.9% year-on-year. 192,000 domestic invention patents were granted, in which service inventions accounted for 95.2% (183, 000) and non-service inventions accounted for 4.8% (9,000). The companies (excluding Hong Kong, Macao and Taiwan regions) ranked top 3 for the quantity of invention patent grants were: Huawei Technologies Co., Ltd (2,314), China Petroleum and Chemical Corporation (1,595), Guangdong OPPO Mobile Telecommunications Corp., Ltd (1,312).

    Till the end of June, 2019, the mainland of China (excluding Hong Kong, Macao and Taiwan regions) owned 1,740, 000 invention patents, in which per 1,000 people owned 125,000 invention patents. The provinces (districts and cities) of China ranked top 3 for the quantity of invention patents owned by per 1,000 people: Beijing (121.8), Shanghai (50.0), Jiangsu Province (28.5).

    In the first half of 2019, 24,000 patent applications were filed through the Patent Cooperation Treaty (PCT), up 4.9% year-on-year, in which 22,000 applications were from China, up 2.8% year-on-year. The provinces (districts and cities) ranked top 3 for the quantity of PCT applications: Guangdong Province (9,807), Beijing (3, 179), Jiangsu Province (1,920).

    In the first half of 2019, CNIPA received 23,000 reexamination requests, up 22.9% year-on-year, and closed 17,000 cases, up 11% year-on-year. CNIPA received 2,800 invalidation requests, up 12.8% year-on-year, and closed 2,900 cases, up 18.9% year-on-year.

    In the first half of 2019, the examination period of the invention patents was 22.7 months; the examination period of the high-value patents was 20.5 months; the examination period of the utility model patents was 6.2 months; the examination period of the design patents was 4 months; the examination period of the patent reexaminations was 11.7 months; the examination period of the invalidation requests was 5 months.

    Trademark:

    In the first half of 2019, the quantity of trademark registration applications in China reached 3,438,000, down 4.1% year-on-year, in which the quantity of trademark registrations reached 3,515,000, up 67.8% year-on-year. Till the end of June, 2019, the quantity of the valid trademark registrations reached 22,743,000, up 35.3% year-on-year, which meant every 5.2 market entities owned one trademark. 

    In the first half of 2019, the quantity of the trademark review applications reached 198,000, and 159,000 cases were closed. The quantity of applications filed through Madrid International Trademark Registration by the Chinese applicants reached 2,849. Till the end of June, 2019, the quantity of the valid applications filed through Madrid International Trademark Registration by the Chinese applicants reached 35,000.

    In the first half of 2019, the average examination period of the trademark registrations was reduced within 5 months; the period of assigning the trademarks was reduced within 4 months; the examination period of the trademark rejections and reexaminations was reduced within 7 months; both the examination period of the trademark modifications and renewals and the period of issuing the Notification of Acceptance of Application for Trademark Registration were reduced within 1 month.

    Geographical Indications:

    In the first half of 2019, 229 geographical indications were registered in China, and 116 companies were approved to use the geographical indications exclusively for the goods. Till the end of June, 2019, the registrations of the geographical indications racked up to 5,090; the products approved to be registered with the geographical indications racked up to 2,380 (including 61 international geographical indications); 8,295 companies were approved to use the special indications; 24 Demonstration Plots of the National Geographical Indications Protection were built up.

    Layout Designs of Integrated Circuits:

    In the first half of 2019, 2,904 registrations of layout designs of integrated circuits were received, up 45.7% year-on-year; 2,487 registrations were certificated, up 52% year-on-year.

    Intellectual Property Protection and Utilization:

    In the first half of 2019, the integrated law enforcement covering the patent and the trademark administrative enforcement of laws was carried out. 6,529 infringing and counterfeiting patents were investigated; 11,500 illegal trademark cases were handled. 

    In the first half of 2019, the pledge financing of the patents and the trademarks was newly increased to 58.35 billion yuan, up 2.5% year-on-year; the quantity of the pledge projects reached 3, 086, up 21.6% year-on-year, in which the patent pledge financing was 40.4 billion yuan, and the quantity of the pledge projects reached 2,709 covering 13,000 patents.

    The statistical data of the first half of 2019 was embodied with 5 features.

    Major Features

      Firstly, the quantity of the invention patents owned by per 1,000 people met the goal of the National 13th Five-Year Plan early. 

    Secondly, the quantity of intellectual property applications filed by the foreign applicants was steadily grown.

    In the first half of 2019, the quantity of the invention patent applications filed by the foreign applicants reached 78,000, up 8.6% year-on-year; the quantity of the trademark applications filed by the foreign applicants reached 12,700, up 15.4% year-on-year. The stable growth of the applications of the invention patents and the trademarks demonstrated the faith for our intellectual property protection from the international communities.

    Thirdly, the structure of the national invention patent applications was constantly optimized.

    In the first half of 2019, the service inventions accounted for 91.2% of the national invention patent applications, up 5.7% compared to the same period of 2018; the non-service invention patent applications were declined by 46%, with a continuously declining proportion. These demonstrated the constant optimization of the structure of the national invention patent applications.

    Fourthly, the periods of the examinations and the registrations were continuously reduced.

    In the first half of 2019, the examination period of the high-value patents was reduced by 0.5 month from the beginning of the year; the average period of registering trademarks was reduced by 1 month from the beginning of the year. These demonstrated that the efforts to implement and deepen the reform of “streamline the government, delegate power and improve government services” and fully reduce the intellectual property examination and registration periods had made achievements.

    Fifthly, China’s intellectual property utilization efficiency was greatly promoted.

    In the first half of 2019, the national patent pledge financing projects increased by 33% year-on-year, in which the small projects of below 10 million yuan (including 10 million yuan) accounted for 68.6%. This demonstrated that more innovative medium, small and micro businesses got the financing support through the IP pledge, and the IP utilization efficiency was greatly improved.
