Recently, the Supreme People’s Procuratorate issued a notification requiring procuratorate departments at all levels, for propose of nurturing the environment to protect the legitimate rights and interests of entrepreneurs, and support innovation and entrepreneurship by prevention, supervision, education and protection.
According to the notification, procuratorate departments should be clear of the boundaries of laws, and the distinction between crime and non-crime to protect the legitimate rights and normal business activities of entrepreneurs. It is also required that procuratorate departments should strengthen punishments on crimes of intellectual property infringements, enhance examination on arrestment and prosecution, and fight against the infringement crimes that disrupt the market order. Meanwhile, procuratorate departments are required to regulate their own judicial practices, improve their case handling mode, and minimize the possible negative impacts on the legitimate rights and interests of entrepreneurs and normal economic activities.
The notification stresses that the supervision of criminal litigation and judicial fairness should be improved. Efforts should also be made to strengthen supervision on public power, such as the power of investigation into economic crimes, and to improve the rules in litigation evidence. The notification also defines the necessity to strengthen the civil administration procuratorate work, criminal appeal and state compensation cases, so as to form a diversified pattern to protect the legitimate rights and interests of entrepreneurs.
